The man accused of stalking Miley Cyrus will not be indicted due to a lack of evidence.
In August, Mark McLeod was arrested and charged with following the 16-year-old on the set of forthcoming movie The Last Song.
The 53-year-old was later transferred to a felony court. He was expected to face higher charges than the attempted stalking, disorderly conduct and obstruction of a police officer misdemeanor offences that he was previously arraigned for.
However, a Georgia grand jury refused to charge McLeod yesterday and cited insufficient evidence to show that he targeted Cyrus, E! reports.
His case will now move to a state court, where the disorderly conduct and obstruction misdemeanour counts are to be examined.
“The grand jury showed some common sense, which no-one else in this case seems to have, which is there’s nothing to these charges,” his attorney James Byrne said.
“He didn’t stalk anyone, he didn’t threaten anyone. He acted strangely and that’s why he’s in jail.”
McLeod will attend a hearing tomorrow and is likely to enter a plea bargain deal of 24 months probation with credit for the three months he has served, should the judge deem the deal acceptable. He will also go through a mental health evaluation and complete recommended treatment.
